Legal Project Management Plan & Checklist
Purpose of this Guide: Use this plan when a debtor has been served with court proceedings in New Zealand but has failed to file a Statement of Defence within the statutory deadline. This guide helps legal practitioners compile default applications, obtain administrative sealing for liquidated demands, or navigate Formal Proof Hearings for unliquidated claims.
Jurisdiction: High Court and District Court of New Zealand (national jurisdiction). This fork is governed by Rule 15.4 of both the District Court Rules 2014 and High Court Rules 2016.
Verify all prerequisite documentation has been obtained, cross-reference against the statutory requirements for this matter type, and confirm compliance with practice direction protocols.
The Process at a Glance: The process starts by verifying the expiry of the defence pleading window. The practitioner then drafts and files the default application package, including an affidavit of service and a verifying affidavit. If the debt is a liquidated demand, judgment is entered administratively by the Registrar. If the demand is unliquidated, the practitioner prepares affidavit evidence of damages and represents the client at a Formal Proof Hearing before a judge.
Key Legislation and Case Law: Governed by District Court Rules 2014 Rule 15.4 and Rule 15.7; High Court Rules 2016 Rule 15.4 and Rule 15.7 (definition of liquidated demand and administrative entry processes).

Prepare the relevant forms and supporting materials required under the applicable legislation, ensuring all mandatory fields are completed and all attachments are properly certified.
Draft and dispatch formal correspondence addressing the procedural requirements at this stage, including any required notices, requests for information, or proposals for resolution.
Required under Rule 15.4 of the High Court Rules 2016 and District Court Rules 2014. Witnessing must comply with the Oaths and Declarations Act 1957.
Coordinate the collection and review of all financial documentation required for disclosure, including statements, valuations, and supporting schedules as mandated by the rules.
Liquidated demands under Rule 15.7 allow automatic registrar sealing, bypassing a judicial hearing and reducing legal costs.
Conduct a thorough review of all filed materials to ensure compliance with court requirements, verify service obligations have been met, and prepare for the next procedural milestone.
Unliquidated demands require a Formal Proof Hearing where the plaintiff bears the burden of proving the quantum of damage to the satisfaction of a judge.
Assess the strategic considerations for interim applications, prepare supporting evidence, and draft the necessary documentation for urgent or time-sensitive relief sought.
