Legal Project Management Plan & Checklist
Purpose of this Guide: Use this fork when a client is currently subject to a SOIRA order and has become eligible to apply for termination under s 490.015 of the Criminal Code. The termination pathway requires demonstrating to the court that continued registration would be grossly disproportionate to the public protection interest, assessed against the risk the person poses. Timing is critical: applications are governed by strict waiting periods and, if refused, a 5-year re-application bar applies under s 490.017.
Jurisdiction: Federal, under ss 490.015 to 490.017 of the Criminal Code of Canada. The application is made to the superior court of the province in which the order was made.
The Process at a Glance: Confirm the waiting period has elapsed - 5 years for a 10-year order, 10 years for a 20-year order, 20 years for a life order. Retain a forensic psychologist to conduct an updated risk assessment using validated actuarial tools. Compile a rehabilitation evidence package including treatment completion, stable housing, employment, and community support. File the s 490.015 application with the court, serve the Crown and the registration centre. Appear at the termination hearing. If granted, notify the RCMP registry and the Ontario Sex Offender Registry if applicable. If refused, diary the 5-year re-application eligibility date under s 490.017 immediately.
Key Legislation and Case Law: Criminal Code s 490.015 - termination application procedure and test. s 490.016 - hearing procedure. s 490.017 - bar on re-application for 5 years after refusal. SOIRA SC 2004 c 10 - registration obligations continuing until order terminated. Ontario AG v G 2020 SCC 38 - grossly disproportionate standard under s 12 Charter informs the termination test. Record suspension information - available in parallel as an alternative exit from both registries.
